If informal resolution fails, all disputes shall be finally settled by binding arbitration administered by the Brazil-Canada Chamber of Commerce (Câmara de Comércio Brasil-Canadá - CCBC) in accordance with its Arbitration Rules. The arbitration shall be conducted by a single arbitrator appointed in accordance with the Rules. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. The place of arbitration shall be São Paulo, Brazil. The language of the arbitration shall be Portuguese or English, as agreed by the parties or determined by the arbitrator.

Class Action Waiver

Any arbitration under these Terms of Use will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING.
